These conditions of use regulate access and use of the website with the domain name www.platazueras.com (hereinafter the Website), all the sub-domains that depend on it and the content and services that the owner of the Website offers to its users, and establish, together with the Cookie Policy and the Privacy Policy on the management of users' personal data, the terms and conditions governing the Website.
OBJECT OF THE CONTRACT
These Conditions of Use form the entire contract through which the conditions of purchase of all the Products made available to Users through the www.platazueras.com website is regulated. By placing an order, you guarantee that you are over 18 years of age and have the legal capacity to enter into binding contracts. We reserve the right to cancel fraudulent, false or speculative orders, as well as orders placed by a customer with whom there may be a dispute over previous orders or when there are doubts as to whether the customer is violating any of the specified conditions of purchase or is participating in any criminal activity. Access to the Website or its use by the User and the purchase of any Product necessarily and without reservation implies knowledge and acceptance of these Terms of Use. OBLIGATIONS OF THE USER
As a User you are obliged to communicate to Zueras Art i Plata all the necessary data to access and use the services of this Web Site. The data must be truthful and current and you agree that we can use them to contact you in case it is necessary. The data will not be transferred to third parties as indicated in the Privacy Policy of this Web Site. It will be necessary for you to provide us with all the mandatory information in order to place your order. We will not be responsible in any case for possible delays or failures in delivery as a result of error or omission of these data. The User must make proper use of the services included in the Website, in accordance with the legal system (Spanish) and will not carry out any activity that hinders or interferes with its operation.

2. PURCHASE OF PRODUCTS
HOW TO BUY
You will be able to browse the Website until you find the Product you want to buy. By clicking on the product, you will be able to access its details and follow the procedure indicated by the Website and fill in the required fields in order to proceed with the purchase by accepting these general conditions and privacy policies. Once your purchase is completed you can proceed to "Pay" the order. You will then receive an e-mail confirming that the order has been accepted. The contract of sale between the user and Zueras Art i Plata will be formalized once the user has received the e-mail confirming the purchase. The object of the contract will be the Products indicated in the order.
Availability of Products
All orders are subject to availability. If, once the Shipping Confirmation has been sent, Zueras Art i Plata could not have the product for any reason, we would contact the User as soon as possible. Then, it will be offered to the User:
- The possibility to change it for another product of the same price
- the refund of the amount of the unavailable product, choosing either the cancellation of the entire order (voiding the purchase-sale) or the cancellation of the unavailable product.
In this case, the amount paid will be refunded within 14 working days.
Once the order has been confirmed, it will not be possible to modify or cancel the order through the Website, so you will have to contact us. In this case, the order may be modified or cancelled if the article is not in the dispatch phase.
3. PRICE, TAXES AND PAYMENT OF PRODUCTS
The applicable prices of each product will be those published on the website including VAT, with the exception of the Canary Islands, Ceuta and Melilla, where deliveries will be considered exempt from VAT, but not from the application of the taxes and tariffs derived from the entry and exit of the product from these territories, which will be charged to the consumer, in accordance with current regulations. The applicable tax rate will be the one legally in force at any given time. All prices are shown in Euros (euros) and will be considered the final price including VAT except in the cases specified in the previous paragraphs. If there is any error in the price of a Product requested by any User, Zueras Art i Plata will contact him/her as soon as possible and inform him/her of the error and give him/her the possibility of reconfirming the order with the corrected error or cancelling the order. If Zueras Art i Plata is unable to contact the User, the order will be considered cancelled and the amounts that the User had paid will be returned in full. The prices can change at any time, but the possible changes will not affect products of already confirmed orders.

To minimise the risk of unauthorised access, our Secure Payment system guarantees maximum security and minimises fraud.
CES (SECURE E-COMMERCE)
Our Virtual POS integrates CES (Secure Electronic Purchase) which, under the international protocols Verified by Visa and MasterCard SecureCode (both based on 3DSecure technology), provides high security and protection in payments. In 2019, with the implementation of 3DSecure 2.x, they have been renamed VISA SECURE and MASTERCAD IDENTITY CHECK.
CVV
The virtual POS requires the mandatory introduction of the card's CVV2 (series of three numbers on the back of the card) as an anti-fraud measure.
VELOCITY CHECKS
The security filters or Velocity Checks that are configured in the virtual POS enable fraud prevention. Different parameters of the purchase data such as IP, card number, number of attempts, etc. are validated and if the transaction does not pass these security filters favourably, the transaction is denied.
The merchant will proceed to the immediate cancellation of the card operations when an undue charge has been made, or when the sale and delivery of goods has not been fully completed.
The merchant will not store card data in any way on its premises, unless this is necessary for its operation, in which case it will be subject to the PCI/DSS security programme of VISA and MASTERCARD. Even in this case it is strictly forbidden to store the CVV2 under any circumstances.
The merchant shall be subject to the Spanish Consumer and User Protection laws, and in particular to the articles regulating Non-Presential Sales. For this purpose, Law 3/2014, of 27 March, which amends the revised text of the General Law for the Defence of Consumers and Users and other complementary laws, approved by Royal Legislative Decree 1/2007, of 16 November, and which implements Directive 2011/83/EU of the European Parliament, applies.
4. SHIPMENTS AND DELIVERIES
SHIPMENTS
The orders at national level, Andorra and Portugal (unless it is a special product with other specifications), will be prepared and sent within 24 to 48 hours from the day after purchase and excluding weekends and public holidays, we do not deliver on weekends. If there is any delay, we will notify you soon as possible.
Shipments are made from Barcelona. Costs and shipping times vary depending on the place of delivery.
When the order has been sent, a message will be sent to you by e-mail or SMS with the order tracking number.
Once the shipments have been processed, they cannot be cancelled or modified. Please make sure that the information provided for shipment is correct. PLATA ZUERAS is not responsible for any incidents caused by the delivery address provided.
PLATA ZUERAS is not responsible for not being able to send the order due to causes beyond the company's control, such as extreme weather conditions, fires, strikes, pandemics, among others.

5. EXCHANGES AND RETURNS
If you have bought a product in ZUERAS and it is the case:
- The product does not convince me and I want to change it for another one.
- I want to change the size (like a ring size).
- I want to cancel the purchase.
In these cases, you have 14 days from the day you have received the product to make an exchange or a return. The product must be sent in its original packaging in perfect condition with no signs of use and in the same conditions as received.
Shipping costs associated with exchanges and returns will be charged to the consumer.
No returns or exchanges are accepted in the following cases:
- Product damaged by use.
- Product damaged by contact with abrasive materials.
- After 14 days from the date the product was received.

Solutions:
- Exchange for another product. If the amount is less, the refund will be made by the same means that made the payment.

The new product will be sent or the amount returned once the product has been received and reviewed. The return of the amount can take between 2 or 3 working days, depending on the bank. DEFECTIVE OR WRONG PRODUCT

Solutions:
- Change for the same product. Once we receive the defective one, we will send you a new one. If there is no stock you can change for another product or ask for a refund.
- Change for another different product. If the amount is less, we will refund the amount by the same means that made the payment. If the amount is higher, the missing amount will be paid by the same means as the purchase.
- If you want to return the amount will be made by the same means that made the purchase or by bank transfer.
We will send the new product or refund the amount once we have received the product and reviewed it. The return of the amount can take between 2 or 3 working days, depending on the bank. All matters relating to this site are governed by Spanish law and are subject to the jurisdiction of the competent courts in Spain without regard to conflict of law principles.
